Terms and Conditions

Please read these terms carefully before using InnerVoice services.

Welcome to InnerVoice. These Terms and Conditions ("Terms") govern your access to and use of the InnerVoice applications, websites, and services (collectively, the "Service") provided by iTherapy, LLC ("Company," "we," "us," or "our").

By accessing or using the Service, you agree to be bound by these Terms. If you do not agree to these Terms, do not access or use the Service.

1. Acceptance of Terms

By creating an account, downloading our applications, or using any part of the Service, you acknowledge that you have read, understood, and agree to be bound by these Terms and our Privacy Policy. If you are using the Service on behalf of an organization, you represent and warrant that you have authority to bind that organization to these Terms.

2. Description of Service

InnerVoice is an augmentative and alternative communication (AAC) application designed to support speech, language, and communication development. The Service includes:

  • InnerVoice Classic (iOS): Mobile application available for purchase on the Apple App Store
  • InnerVoice for Education (iOS): FERPA-compliant mobile application for educational settings
  • InnerVoice Learning (Web): Web-based subscription platform with Visual Stories, Practice Mode, and Story Mode

Important: The Service is intended as a supportive tool and is not a substitute for professional speech-language pathology services, medical advice, diagnosis, or treatment.

3. Eligibility

You must be at least 18 years of age to create an account or purchase the Service. If you are under 18, you may only use the Service under the supervision of a parent, legal guardian, or authorized educator. By using the Service, you represent that you meet these eligibility requirements.

4. Account Registration

To access certain features of the Service, you may be required to create an account. You agree to:

  • Provide accurate, current, and complete information during registration
  • Maintain and promptly update your account information
  • Maintain the security and confidentiality of your login credentials
  • Accept responsibility for all activities that occur under your account
  • Notify us immediately of any unauthorized use of your account

You may not share your account credentials with others or allow multiple people to use a single account, except as expressly permitted for Family plans.

5. Subscription Terms and Payments

5.1 iOS Applications

InnerVoice iOS applications are available for one-time purchase through the Apple App Store. All purchases are subject to Apple's Terms of Service and refund policies. We do not process payments for iOS applications directly.

5.2 Web Platform Subscriptions

InnerVoice Learning (Web) is available on a subscription basis. By subscribing, you agree to:

  • Pay all applicable fees for your selected subscription plan
  • Authorize us to charge your payment method on a recurring basis
  • Accept that subscription fees are billed in advance on a monthly or annual basis

5.3 Cancellation

You may cancel your subscription at any time through your account settings. Cancellation will take effect at the end of your current billing period. We do not provide refunds or credits for partial subscription periods.

5.4 Price Changes

We reserve the right to modify our pricing at any time. Price changes will not affect your current subscription period but will apply to subsequent renewal periods. We will provide reasonable notice of any price changes.

6. Acceptable Use

You agree not to use the Service to:

  • Violate any applicable local, state, national, or international law or regulation
  • Infringe upon the rights of others, including intellectual property rights
  • Upload, transmit, or distribute any content that is unlawful, harmful, threatening, abusive, harassing, defamatory, vulgar, obscene, or otherwise objectionable
  • Attempt to gain unauthorized access to the Service, other accounts, or computer systems
  • Interfere with or disrupt the Service or servers or networks connected to the Service
  • Reverse engineer, decompile, or disassemble any aspect of the Service

7. User Content

7.1 Your Content

The Service may allow you to upload, store, or transmit content, including photos, audio recordings, and custom vocabulary ("User Content"). You retain ownership of your User Content, but you grant us a limited license to use, store, and process your User Content solely for the purpose of providing and improving the Service.

7.2 Content Restrictions

You are solely responsible for your User Content. You represent and warrant that:

  • You own or have the necessary rights to use and authorize use of your User Content
  • Your User Content does not violate the rights of any third party
  • Your User Content complies with these Terms and all applicable laws

7.3 Content Removal

We reserve the right to remove any User Content that violates these Terms or that we determine, in our sole discretion, is otherwise objectionable.

8. Intellectual Property

8.1 Our Intellectual Property

The Service, including all content, features, and functionality (including but not limited to text, graphics, logos, icons, images, audio clips, video clips, data compilations, and software), is owned by iTherapy, LLC or its licensors and is protected by United States and international copyright, trademark, patent, trade secret, and other intellectual property laws.

8.2 Limited License

Subject to your compliance with these Terms, we grant you a limited, non-exclusive, non-transferable, revocable license to access and use the Service for your personal, non-commercial use (or for educational use if you have purchased an Education license).

9. Privacy and Data Protection

9.1 Privacy Policy

Our collection and use of personal information is governed by our Privacy Policy, which is incorporated into these Terms by reference. By using the Service, you consent to our collection and use of information as described in our Privacy Policy.

9.2 Children's Privacy

We are committed to protecting the privacy of children. Our Service may be used by children under the supervision of parents, guardians, or educators. We comply with the Children's Online Privacy Protection Act (COPPA) and do not knowingly collect personal information from children under 13 without verifiable parental consent.

9.3 FERPA Compliance

Our InnerVoice for Education application is designed to comply with the Family Educational Rights and Privacy Act (FERPA). Educational institutions using the Service are responsible for obtaining any necessary consents and for ensuring compliance with FERPA and other applicable education privacy laws.

9.4 Data Security

We implement reasonable administrative, technical, and physical safeguards to protect User Content and personal information. However, no method of transmission over the Internet or electronic storage is 100% secure, and we cannot guarantee absolute security.

10. Disclaimer of Warranties

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT.

THE SERVICE IS NOT INTENDED TO DIAGNOSE, TREAT, CURE, OR PREVENT ANY DISEASE OR CONDITION. THE SERVICE IS A SUPPORTIVE TOOL AND IS NOT A SUBSTITUTE FOR PROFESSIONAL SPEECH-LANGUAGE PATHOLOGY SERVICES, MEDICAL ADVICE, DIAGNOSIS, OR TREATMENT. ALWAYS SEEK THE ADVICE OF A QUALIFIED HEALTHCARE PROVIDER WITH ANY QUESTIONS YOU MAY HAVE REGARDING A MEDICAL OR DEVELOPMENTAL CONDITION.

11. Limitation of Liability

TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL ITHERAPY, LLC, ITS AFFILIATES, OFFICERS, DIRECTORS, EMPLOYEES, AGENTS, SUPPLIERS, OR LICENSORS BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES.

IN NO EVENT SHALL OUR TOTAL LIABILITY TO YOU FOR ALL CLAIMS ARISING FROM OR RELATED TO THE SERVICE EXCEED THE AMOUNT YOU PAID TO US, IF ANY, FOR ACCESS TO THE SERVICE DURING THE TWELVE (12) MONTHS IMMEDIATELY PRECEDING THE DATE OF THE CLAIM.

12. Indemnification

You agree to indemnify, defend, and hold harmless iTherapy, LLC and its affiliates, officers, directors, employees, agents, suppliers, and licensors from and against any and all claims, liabilities, damages, losses, costs, and expenses (including reasonable attorneys' fees) arising out of or related to your use of the Service, your User Content, your violation of these Terms, your violation of any rights of another party, or your violation of any applicable law or regulation.

13. Termination

13.1 Termination by You

You may terminate your account at any time by contacting us at admin@itherapyllc.com or through your account settings.

13.2 Termination by Us

We may suspend or terminate your access to the Service at any time, with or without cause, and with or without notice. Reasons for termination may include breach of these Terms, conduct that we determine is harmful to other users, or extended periods of inactivity.

13.3 Effect of Termination

Upon termination, your right to access and use the Service will immediately cease. We may delete your account and User Content. Provisions of these Terms that by their nature should survive termination will survive.

14. Dispute Resolution

14.1 Governing Law

These Terms and any disputes arising from or related to the Service shall be governed by and construed in accordance with the laws of the State of California, without regard to its conflict of law principles.

14.2 Informal Resolution

Before filing any formal legal action, you agree to attempt to resolve any dispute informally by contacting us at admin@itherapyllc.com. We will attempt to resolve the dispute informally within 60 days.

14.3 Arbitration

If we cannot resolve a dispute informally, any controversy or claim arising out of or relating to these Terms or the Service shall be settled by binding arbitration administered by the American Arbitration Association. The arbitration shall be conducted in Solano County, California.

14.4 Class Action Waiver

YOU AND ITHERAPY, LLC AGREE THAT EACH MAY BRING CLAIMS AGAINST THE OTHER ONLY IN YOUR OR ITS INDIVIDUAL CAPACITY AND NOT AS A PLAINTIFF OR CLASS MEMBER IN ANY PURPORTED CLASS OR REPRESENTATIVE PROCEEDING.

15. Changes to Terms

We reserve the right to modify these Terms at any time. If we make material changes, we will notify you by posting the updated Terms on our website and updating the "Last Updated" date. Your continued use of the Service after the effective date of the revised Terms constitutes your acceptance of the changes.

16. General Provisions

Entire Agreement

These Terms constitute the entire agreement between you and iTherapy, LLC regarding the Service.

Severability

If any provision is found unenforceable, the remaining provisions remain in full force.

Waiver

Our failure to enforce any right shall not be deemed a waiver of such right.

Assignment

You may not assign these Terms without our prior written consent.

19. California Residents

If you are a California resident, you may have additional rights under the California Consumer Privacy Act (CCPA). Please refer to our Privacy Policy for information about how we collect, use, and disclose your personal information and how you may exercise your rights under the CCPA.

Under California Civil Code Section 1789.3, California users may reach the Complaint Assistance Unit of the Division of Consumer Services of the California Department of Consumer Affairs by mail at 1625 North Market Blvd., Sacramento, CA 95834, or by telephone at (916) 445-1254.

20. International Users

The Service is operated from the United States. If you are accessing the Service from outside the United States, please be aware that information you provide to us or that we collect may be transferred to, processed, and stored in the United States. By using the Service, you consent to such transfer, processing, and storage of information in the United States.

By using InnerVoice, you acknowledge that you have read, understood, and agree to be bound by these Terms and Conditions.
